A 28 year old man has been acquitted of rape by High Court Judge Justice Vinsent Perera.
He was charged with the rape of a child under the age of 13 years.
The alleged incident occurred in November 2017 in Kadavu.
The complainant is a relative of the man.
In his judgement today, Justice Perera said this was a case of recognition and evidence in the case on identification was not addressed.
Justice Perera overturned the unanimous guilty opinion of the assessors.
