21-year old Petero Bai who is alleged to have raped a class three student told the High Court today that he was allegedly assaulted by Prison Officers while in custody.
Defense counsel Barbara Malimali told High Court Judge Justice Daniel Gouder that she is concerned about her client as he was allegedly assaulted, has been isolated in solitary confinement, and it is under these grounds that she is applying for bail.
Malimali told the court that she has filed affidavits on the 4th of May, and is awaiting a response from the DPP=s office in relation to her bail application, and she is concerned about the delay.
Meanwhile Judge Gounder today asked the court to inform him about the health condition of the class three student.
DPP counsel Paulini Madanavosa told the court that the girl is still recovering at home and has not gone to school yet, and is under the custody of her mother and grandparents.
Bai is alleged to have raped a class three student, who was found unconscious in the school toilet.
He is alleged to have punched the victim before sexually assaulting her.
The bail hearing will be heard on Thursday.
