High Court Judge, Justice Vinsent Perera has acquitted a man who was charged with rape.
The alleged incident happened in Savusavu in June last year.
It was heard in court that the accused wanted to have sexual intercourse with the complainant when she met the accused at around 8am on 4th June last year.
It was heard that the woman was walking towards the bus stop and when she did not agree, the accused allegedly took her to his farm and then had sexual intercourse with her without her consent.
While giving his judgement, Justice Perera says the evidence presented in this case does not establish the offence of rape beyond reasonable doubt.
He says given all the evidence led in this case and the complainant’s demeanour and deportment when she gave evidence, he did not find the evidence given by the complainant to be credible and reliable.
The Judge says the account she gave was improbable and it was clear that the complainant did not disclose what exactly happened between her and the accused on the day the alleged incident took place.
