A man who was charged with the rape of a form three student has been acquitted by the Labasa High Court.
The man allegedly raped the boy last year.
While giving his judgement ,Judge, Justice Riyaz Hamza says having considered the totality of the evidence in this case, he is of the opinion that the prosecution evidence is not entirely credible and reliable.
Justice Hamza says the defence suggested to the complainant that he had failed to inform the police about what the accused had allegedly done to him while the complainant was lying down near the mango tree.
Justice Hamza says the defence also put to the complainant that he had also failed to inform the police that the accused had allegedly kicked him on his ribs while he was lying near the mango tree.
The Judge says the complainant agreed that the above two matters are not found in his police statement as he had forgotten to tell this to the police.
