SODELPA Leader Sitiveni Rabuka's lawyer is adamant the identity of a witness be revealed to them before Rabuka's trial can proceed.

Rabuka's lawyer Filimone Vosarogo had earlier made two requests: one that the identity of the witness who had filed the complaint against Rabuka about the false declaration be released and two, that the report generated out of the matter be disclosed to them.

Vosarogo has cited that if he were to be tried under a certain section, it allows for disclosure of such information that is required.

He says the information is necessary before Rabuka's trial can proceed on the 15th of this month.

FICAC lawyer Rashmi Aslam has responded that he may release the identity of the witness, provided that the identity is under Court seal and remains between the two parties only.

Magistrate Boseiwaqa has adjourned the case to the 8th of this month where defence will make an application for their request and the Court will decide whether FICAC will reveal the information.

Rabuka is charged by FICAC in relation to the declaration of his assets and liabilities as required under the Political Parties Registration, Conduct, Funding and Disclosures Act.

It is alleged that Rabuka made a false declaration of assets and liabilities to the Supervisor of Elections by failing to provide information namely, the tax liability with Fiji Revenue and Customs Service in the amount of $316,956, the investment and interest income with Raghwan Construction Limited in the amount of $200,000 and $16,000 respectively and the liability with Raghwan Construction in the amount of $120,000, contrary to the Political Parties Act.

The alleged incident occurred on 29th of December last year.

In the second case, he was charged with allegedly breaching bail conditions in his case.

It is alleged that Rabuka spoke to a FICAC witness in the case.
