The election petition case filed by Unity Fiji Party’s Satish Kumar against FijiFirst parliamentarians, Salik Govind and Alexander O’Connor and the Supervisor of Elections has been adjourned to 2:30 this afternoon.
Kumar’s lawyer Jolame Uludole has indicated to the court that they will be looking at calling people to provide oral evidence.
Uludole says they will be looking at about 5 people to provide oral evidence which includes academic, Dr. Ganesh Chand.
FijiFirst lawyer Devanesh Sharma questioned why they did not file this in the affidavit and they cannot make allegations against a party that is not part of the petition.
He has opposed the application to present oral evidecne.
Solicitor General Sharvada Sharma, who is representing the Supervisor of Elections in the matter, also opposed the application.
Sharma says that Uludole has mentioned that they will be producing either one or two Commissioners of Oaths, however their names are not in the affidavit.
He said that there is no mention of Ganesh Chand as well.
Sharma added that the Supervisor of Elections has provided every evidence.
Another elections petition case that has been filed by Jone Dakuvula against the Supervisor of Elections, the Electoral Commission, Voreqe Bainimarama, Aiyaz Sayed‑Khaiyum and Faiyaz Koya has also been adjourned to 2.30pm.
Justice Kamal Kumar has advised Dakuvula that he can file for an appointment of a solicitor to represent him in the hearing.
Dakuvula said that he would like to call Dr. Ganesh Chand as his witness and he will give evidence on the defects of the Protocol of Results.
Dakuvula says that Chand has prepared a report on the matter.
Devanesh Sharma has opposed the application and says that there is no mention of Chand in Dakuvula’s petition and now he will present a report.
Sharma says if this was the case then the report should have been made available from the start.
Bhavna Narayan who is representing the Supervisor of Elections says that Chand cannot be a witness and verify the Protocol of Results adding it will be irrelevant evidence to the proceedings.
Nilesh Prasad who is representing the Electoral Commission also opposed the application adding that the document speaks for itself and does not require an opinion.
Dakuvula says that Chand had a team that had surveyed the Protocol of Results that was received by the Political Parties.
