The Office of the Director of Public Prosecutions had filed to discontinue the case of 19-year-old Deepak Kumar who was charged with the murder of a 7-year-old girl as it was decided by the DPP that the charge against the accused could not be proved beyond reasonable doubt.
Kumar was charged with one count of murder.
The DPP says that an application to discontinue a case is filed when the evidence of criminal wrongdoing falls below the threshold to achieve a conviction.
It says that this decision was made following a review of the matter.
It was earlier alleged that Kumar had driven his vehicle in a reckless manner and his conduct caused the death of the 7-year-old girl on the 21st of July last year.
The incident occurred at the junction of Foster Road and the Tamavua-i-wai Bridge where the girl was crossing the road with an adult and another child.
A report was made by the man at the Delainavesi Police Post where officers and bystanders removed the victim and rushed her to CWM Hospital where she was pronounced dead on arrival.
The 19-year-old was taken into custody by officers at the Totogo Police Station and he was granted bail on the 7th of August last year.
The family of the 7-year-old girl had demanded answers for the withdrawal of the case as this accident had robbed the family of a precious life.
The DPP has not revealed their next step.
