A 28‑year old man has been jailed for 18 years and 6 months for raping his nephew who was 9-years-old when the incident first occurred in 2014.
In his sentence, Justice Riyaz Hamza said a psychological assessment of the complainant pointed out that he had low IQ.
Justice Hamza said the victim was vulnerable, the impact of the crime was traumatic and the man took advantage of the boy's helplessness.
The man was 23-years-old at the time he raped the boy.
It was heard in court that the man is married and has 3 children.
In each of the three counts of rape, Justice Hamza set a sentence of 19 years and ordered that they be served concurrently.
Justice Hamza then considered the time spent in remand which is 6 months, leaving the time to serve as 18 years 6 months imprisonment.
A non-parole period of 16 years 6 months imprisonment has been set.
