The lawyer of the former CEO of the then Fiji Commerce Commission Bobby Maharaj has told the Suva Magistrates Court that he intends to submit a no case to answer application.

Devanesh Sharma says in order to do this, he will require the transcripts of the FICAC witnesses.

The court has ordered the FICAC lawyer, Rashmi Aslam to provide the transcripts by 3pm on 23rd December.

Sharma then intends to make the no case to answer the application on the 17th of January.

The FICAC lawyer will then respond to the submission on the 31st of January.

The case has been adjourned for mention till the 31st of January next year.

Maharaj is charged with one count of abuse of office.

It is alleged Maharaj while being employed by the Commerce Commission in abuse of authority directed an employee of the commission, without conducting an inspection to fill in false information to indicate an inspection was conducted of a trader and a verbal warning was issued against the trader for breaches under the Commerce Commission Decree.
